2.1 Acceptance of Terms

By accessing this website and/or placing an order with OliVita, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into a binding contract, and fully accept these Terms of Service.

If you do not agree to these terms, you must immediately cease using this website and refrain from making any purchases.

2.2 Products and Descriptions

OliVita offers wellness and personal care products designed to support healthy habits and everyday comfort. Products are intended for general wellness purposes.

All product descriptions, usage instructions, safety guidelines, and materials listed on our website are provided for informational purposes only and may be updated or modified without prior notice. OliVita makes reasonable efforts to ensure that product information is accurate; however, we do not guarantee that descriptions, instructions, or other content are error-free, complete, or current.

Product Variations:

Product-Specific Guidelines:

Mouth Tape (OliTape)

OliTape is designed to encourage nasal breathing during sleep. Individual results may vary.

Do NOT use OliTape if:

  • You have difficulty breathing through your nose
  • You suffer from severe nasal congestion or obstruction
  • You have been diagnosed with severe sleep apnea unless cleared by a physician
  • You are experiencing respiratory distress
  • You have broken skin, irritation, or wounds around the mouth
  • You have a known allergy or sensitivity to adhesives

Additional safety guidelines:

  • Do not use while under the influence of alcohol, sedatives, or medications that impair breathing or consciousness
  • Do not use if you are unable to remove the tape independently
  • Discontinue use immediately if you experience discomfort, breathing difficulty, skin irritation, or any adverse reaction
  • Should not be used on infants, young children, or individuals unable to remove the tape themselves

Compression Wear (Bambu Knee Sleeve & Similar Products)

Our compression products are designed to provide support during physical activity and daily use. They are not intended to treat or cure any medical condition.

Do NOT use if:

  • You have deep vein thrombosis (DVT) or other serious circulatory conditions
  • You have severe peripheral arterial disease
  • You experience numbness, tingling, or discoloration while wearing the product
  • You have open wounds or skin infections in the area

Safety guidelines:

  • Discontinue use immediately if you experience pain, excessive tightness, numbness, or circulation issues
  • Consult a healthcare professional if you have diabetes, neuropathy, or circulatory disorders before use

Water Filtration Products

Our water filtration products are designed to improve water taste and reduce certain contaminants for household use. They are not certified as medical devices.

  • Replace filters according to manufacturer instructions
  • Do not use with water that is microbiologically unsafe or of unknown quality
  • Performance may vary based on water source and local conditions

2.4 Pricing and Order Acceptance

All prices displayed on our website are in the currency indicated at checkout and are subject to change without notice.

We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to:

  • Orders where a pricing error has occurred
  • Orders that appear to be placed for resale without prior written authorization
  • Orders placed with incomplete, inaccurate, or unverifiable delivery information
  • Orders where delivery cannot be completed due to recipient unavailability after reasonable attempts

An order confirmation email does not constitute acceptance of your order. Order acceptance occurs only when we dispatch the goods and send a shipping confirmation.

2.4a Cash on Delivery (COD) Terms

OliVita operates exclusively on a Cash on Delivery (COD) payment model. By placing an order, you agree to the following COD-specific terms:

  • Full payment in cash is due at the time of delivery
  • You must have the exact or approximate amount ready upon receipt of your order
  • Our delivery agent is not obligated to provide change
  • Refusing delivery without prior cancellation (see Section 2.4b) constitutes a breach of these Terms of Service and may result in your account being flagged or restricted from future COD orders
  • OliVita reserves the right to require prepayment or decline future COD orders from customers with a history of unjustified delivery refusals
  • COD availability may vary by region, and we reserve the right to withdraw COD services for specific areas at any time

2.4b Order Cancellation

You may cancel your order free of charge before it has been dispatched by contacting us at OliveAIAutomationLLC@gmail.com with your order number.

Once an order has been dispatched, cancellation may no longer be possible. If you no longer wish to receive the order after dispatch, please contact us before refusing delivery.

Repeated or unjustified delivery refusals may result in restrictions on future orders.

2.5 Intellectual Property

All content on the OliVita website, including but not limited to text, graphics, logos, product names (including "OliTape," "Bambu," and other product brands), product designs, images, branding, and website content, is the exclusive property of OliVita and is protected under applicable intellectual property laws.

Unauthorized reproduction, distribution, modification, or commercial use of any content is strictly prohibited and may result in legal action.

2.6 User Accounts

If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account at OliveAIAutomationLLC@gmail.com.

OliVita reserves the right to suspend or terminate accounts at its sole discretion.

2.7 Prohibited Conduct

You agree not to:

  • Use the website for any unlawful purpose or in violation of applicable laws or regulations
  • Attempt to gain unauthorized access to any systems, data, or infrastructure associated with the website
  • Resell OliVita products without prior written authorization from OliVita
  • Make false, misleading, or defamatory statements about OliVita products or services
  • Interfere with or disrupt the integrity, security, or operation of the website or services

2.8 Limitation of Liability

To the fullest extent permitted by applicable law, OliVita, its directors, employees, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Personal discomfort or injury resulting from improper product use
  • Any outcomes related to wellness claims, product performance, or individual results

Use of OliVita products is at your own discretion and risk.

In no event shall OliVita's total aggregate liability exceed the amount paid by you for the specific product giving rise to the claim.

Some jurisdictions do not allow certain liability exclusions; in such cases, liability is limited to the maximum extent permitted by law.

2.9 Indemnification

You agree to indemnify, defend, and hold harmless OliVita and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms of Service
  • Your misuse of OliVita products
  • Your failure to follow safety instructions or product guidelines
  • Your violation of any applicable law or regulation

2.10 Dispute Resolution and Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to conflict-of-law provisions.

Any dispute arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Albuquerque, New Mexico, except that either party may seek injunctive relief in a court of competent jurisdiction.

EU consumers retain all rights granted under applicable EU consumer protection legislation, including Directive 2011/83/EU on Consumer Rights, and nothing in these terms shall override those rights.

2.11 Force Majeure

OliVita shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Pandemics
  • War or civil unrest
  • Government actions
  • Supply chain disruptions
  • Failures of third-party logistics providers

We will make reasonable efforts to notify customers of delays and resume operations as soon as practicable.

2.12 Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed from these terms.

The remaining provisions shall continue in full force and effect.

2.13 Changes to Terms

OliVita reserves the right to update or modify these Terms of Service at any time. Changes will become effective upon posting to the website with an updated "Last Updated" date.

Your continued use of the website or purchase of OliVita products after such changes constitutes acceptance of the revised terms.
